Mr. Matt Dumstorf—who is not a psychiatrist—used his personal interpretation of policy to override medical fact.

Why It Matters: This case challenges the FAA’s use of outdated internal surveys to infer “alcohol dependence” from BAC levels alone—a practice discredited in clinical care. A win here could end the “BAC equals dependence” rule and affirm pilots’ right to choose their own qualified providers.
